INTERNATIONAL TERMS AND CONDITIONS

International Compliance: Customers are responsible for verifying that their order complies with all laws and regulations of their respective countries. Our company is not liable for any items seized or confiscated by customs authorities. The customer acknowledges and agrees to bear all legal and regulatory responsibilities associated with their purchase.

Currency and Conversion Rates: All transactions on our website are processed in [USD]. Customers are responsible for any currency conversion charges incurred. Shopify will facilitate this in some cases. Refunds, if applicable, will be processed in the same currency. We are not responsible for any loss due to currency fluctuation.

Delivery and Risk of Loss: The risk of loss and title for items purchased pass to the buyer upon our delivery to the carrier. This policy indicates that responsibility for the goods transfers from our company to the customer at the point of carrier handover.
Limitation of Liability for International Use: We are not liable for any indirect, incidental, special, or consequential damages resulting from the use of, or the inability to use, our website or products under laws outside of our governing jurisdiction.

Customs, Duties, and Additional Charges: Customers are responsible for all duties, taxes, and customs clearance fees associated with their order. These additional costs are beyond our control and may vary by country.

Language of Agreement: This agreement is conducted in English. Any translations provided are for convenience only. In the event of discrepancies or disputes, the English version of this agreement will take precedence.

International Returns Policy: International orders are generally considered final and non-returnable. Exceptions, if any, are subject to our discretion and will be outlined in this section. The process for returns, if applicable, including conditions and procedures, will be detailed here. Exclusive Beauty Club uses Shopify Markets Pro for all international shipping through DHL or other carrier services. Transit times maybe vary. Please allow an additional 1-2 business days for handling. Any customs fees, duties, taxes, shipping costs, return shipping costs, handling or any other fees other than the product cost will not be refunded in the event that an international return is accepted.

Force Majeure: We shall not be held responsible for the non-delivery or delayed delivery of products resulting from force majeure events including but not limited to natural disasters, wars, or customs delays.

Electronic Communications: By using our website or sending emails to us, you consent to receive electronic communications from us. This includes order confirmations, notices, updates, and other types of information related to your use of our website.
Amendment to Terms: We reserve the right to amend these terms and conditions at any time. All amendments will be posted on our website and, where feasible, notified to you via email. Your continued use of our website after such amendments will constitute your acceptance of the new terms.

Promotional Electronic Gift Card Policy: Please review the following policy regarding the use and terms of promotional electronic gift cards:
1. Eligibility for Promotional Electronic Gift Cards:
   -Promotional electronic gift cards are offered as a complimentary gift with qualifying purchases as specified in the promotional details.
   - Customers must complete a qualifying purchase to receive a promotional electronic gift card.
2. Expiration of Promotional Electronic Gift Cards:
   - All promotional electronic gift cards expire 90 days from the date of receipt.
   - The expiration date will be clearly stated in the email containing the electronic gift card. Please ensure to use your electronic gift card before this date, as expired cards cannot be reissued or extended.
3. Returns and Cancellations:
   - If an order that qualified for a promotional electronic gift card is returned in whole or in part, the electronic gift card will be cancelled. 
   - If the promotional electronic gift card has already been used, the value of the card will be deducted from the refund amount.
4. Usage of Promotional Electronic Gift Cards:
   - Promotional electronic gift cards can be used towards the purchase of products on the Exclusive Beauty Club website.
   - They cannot be redeemed for cash or used to purchase other gift cards.
   - Only one promotional electronic gift card can be used per transaction unless otherwise specified.
5. General Terms:
   - Promotional electronic gift cards are non-transferable and can only be used by the recipient.
   - Promotional electronic gift cards are only valid for use on the Exclusive Beauty Club website and are not applicable to any in-store purchases, if applicable.
   - Exclusive Beauty Club reserves the right to modify or cancel this promotional electronic gift card offer at any time, including adjusting the expiration period, eligibility criteria, and other terms.

Applicable Law: By visiting EXCLUSIVE BEAUTY CLUB, you agree that the laws of the state of Florida, USA without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and EXCLUSIVE BEAUTY CLUB or its associates. 

Disputes: Any dispute relating in any way to your visit to EXCLUSIVE BEAUTY CLUB or to products you purchase through EXCLUSIVE BEAUTY CLUB shall be submitted to confidential arbitration in Florida, USA except that, to the extent you have in any manner violated or threatened to violate EXCLUSIVE BEAUTY CLUB’s intellectual property rights, EXCLUSIVE BEAUTY CLUB may seek injunctive or other appropriate relief in any state or federal court in the state of Florida, USA and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
